US Fashion Label – Outsourcing
Advising a major US fashion company in relation to labour law disputes at supplier’s factory in Madagascar. Advice included detailed review of all contracts and collective agreements, advice on personnel and union representation as well as advice on the provisions for termination of contract. We further advised on the mechanics of court procedure and alternative strategies to reduce exposure and publicity.
US Design House – Local Representation
Advising a US investor on the procedure for retrenching staff. Advice included detailed review of procedure including calculations of wages, holidays, overtime and bonus in addition to highlighting customary practices within the industry concerned. This was a very sensitive matter and we were able to assist the client in resolving their difficulties satisfactorily.
Due Diligence – Corporate Acquisition
Advising a foreign investor on the employment liabilities of over 100 employees in the local company subject to the acquisition. Advice included reviewing contracts and quantifying liabilities in the event of any post-closing terminations.
Employment Rules – Foreign InvestorWe are currently advising a foreign investor on its employment law obligations. We are drafting model contracts for staff as well as putting in place the Workplace Rulebook required for any firm with more than ten staff.
